1. The Defendants jointly share KRW 36,050,000 with respect to the Plaintiff and the period from October 30, 2019 to November 21, 2019.
Reasons
1. Basic facts
A. Defendant B around October 2012, 2012, owned by Defendant C, to the Plaintiff, “instant apartment” (hereinafter “instant apartment”).
(C) A real estate lease agreement concerning the lessor’s Defendant C, lessee F, security deposit amounting to KRW 80 million, term of lease from March 4, 2010 to KRW 36 months (hereinafter “instant lease agreement”).
(B) The Plaintiff, on October 16, 2012, requested F to lend money as security to the Plaintiff’s claim for the return of the deposit. B. On October 16, 2012, the Plaintiff: (a) determined the maximum debt amount of KRW 60,00,000,000 to F Company I (hereinafter “I”); (b) granted a loan of KRW 43,00,000 from I; and (c) granted a loan of KRW 43,00,000,000 to Defendant B’s wife account designated by Defendant B, and remitted KRW 3,60,000,000,000,000,000 won, which was deducted from the loan fee of KRW 43,000,000,000,000,000
C. On October 16, 2012, the Plaintiff and F prepared to I a certificate of loan amounting to KRW 43 million, interest rate of KRW 30 million, KRW 3% per month, and December 16, 2012 on the date of repayment. F, on the same day, entered into a contract to transfer the claim for the refund of KRW 80 million to Defendant C with respect to the instant apartment to I and the Plaintiff, and at the time, Defendant C, as children of Defendant B, collected F, an external f, and was present at the site where the said certificate of loan and the contract to transfer the claim was prepared.
Since then, under the instant lease agreement, the fact that Defendant C and F entered into a lease agreement on the instant apartment was false, and it was found that F’s F’s claim for the return of deposit amounting to KRW 80 million against Defendant C was nonexistent. Defendant B was guilty of deceiving KRW 3605 million from the Plaintiff and was prosecuted for suspicion of fraud, etc., and the trial procedure was under way.
