1. The Defendant’s KRW 250,000,000 as well as 5% per annum from February 22, 2018 to May 16, 2020 to the Plaintiff.

Basic Facts

While the Plaintiff was at a pharmacy, on December 12, 2017 (hereinafter “instant real estate”) with the Defendant’s introduction on December 12, 2017, the Plaintiff paid KRW 500,000,000 (150,000,000 for contract deposit, intermediate payment of KRW 10,000,00 for contract deposit, December 13, 2017; the remainder amount of KRW 250,000,00 as of December 18, 2017; the term of lease from December 12, 2017 to December 12, 2027 (hereinafter “instant real estate”); and the Plaintiff paid KRW 150,00 for intermediate payment to the Defendant (hereinafter “instant contract deposit”); and the Plaintiff paid KRW 300,00,000 for intermediate payment to the Defendant up to 120,000,000 for contract deposit and intermediate payment (hereinafter “the instant contract”).

On December 22, 2017, the Plaintiff and C Co., Ltd. terminated the instant lease agreement. On the same day, C Co., Ltd drafted a deed of promissory notes (Law Firm H2017 No. 533, Dec. 28, 2017) with a face value of KRW 250,000,000 on January 15, 2018 on the same day, and on December 28, 2017, the said lease deposit amount of KRW 250,000,000 to the Plaintiff by January 15, 2018, respectively.

On February 2, 2018, the Defendant drafted to the Plaintiff a confirmation statement of facts with the following contents:

The confirmation person: The defendant himself will prepare and take responsibility for the confirmation to promise to pay the amount to the plaintiff not later than February 21, 2018, in the amount of KRW 250,000 (250,000,000).

[Grounds for recognition] According to the above facts of recognition as to Gap evidence Nos. 1 through 8 and the purport of the whole pleadings, the defendant is obligated to pay to the plaintiff 250,000,000 won and 5% per annum as stipulated in the Civil Act from February 22, 2018 to May 16, 2020, the delivery date of a copy of the application for the payment order of this case, and 12% per annum as stipulated in the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.
