On June 27, 2013, A was sentenced to two years of suspended sentence for 6 months of imprisonment at the Incheon District Court for fraud, and the above judgment was finalized on July 5, 2013. On May 13, 2009, Defendant C was sentenced to one year of imprisonment for a violation of the Illegal Check Control Act at the Incheon District Court on May 13, 2009 and completed the execution of the sentence at the Seoul Southern Prison on September 17, 2010.
1. The Defendants’ joint crime decided to newly construct multi-households on the land of the former Si/Gun/Gu. Defendant A was to build a building, Defendant C was to procure building materials, and Defendant B was to take charge of bank loans and sale, but it was not possible to carry out construction due to the lack of initial construction funds. Ultimately, the Defendants conspired to receive investment funds from the victimJ to carry out construction.
around April 30, 2012, the Defendants were located in Yeongdeungpo-gu Seoul Metropolitan Government. From the 111st outdoor rest room of department stores, the Defendants purchased a bill of exchange equivalent to KRW 80 million with the said money, and may purchase more construction materials than the construction materials necessary for the actual construction work by financing the bill, and may start the construction work of the first multi-household housing construction work (hereinafter referred to as the “multi-household housing construction work”) in order to raise part of the construction materials.
On the other hand, if the construction begins, it can obtain a loan from the bank according to the height of the building, and the remaining construction can be completed, and when multi-household housing is sold after the completion of the construction, it means that it shall invest not only investment but also 25 million won to reduce its profits.
