A defendant shall be punished by imprisonment for two years.

Punishment of the crime

On August 22, 2013, the Defendant was sentenced by the Seoul High Court to embezzlement, and imprisonment with prison labor for fraud on August 30, 2013, and the said judgment became final and conclusive on August 30, 2013.

1. On February 2002, the Defendant entered into a title trust agreement with the victim E to complete the registration of transfer of ownership under the name of the Defendant with respect to the amount of 3,170 square meters in Namyang-si, Namyang-si, where the victim purchased, and then entered into a document necessary for the registration of transfer of ownership and kept the above land for the victim after completing the registration of transfer of ownership under the name of the Defendant on March 20, 209.

A. On November 11, 2008, in order to make the registration of the establishment of a neighboring agricultural cooperative with the debtor, the defendant, the mortgagee of the right to collateral security and the creditor of the right to collateral security, at his own discretion, embezzled the above land without obtaining the consent from the victim at the Namyang-dong District Court in the Namyang-dong registry office of Namyang-dong.

B. The above-mentioned on December 29, 2009

At the Namyang District Court's registry office as stated in paragraph (1), the registration of the establishment of a neighboring agricultural cooperative with the debtor, the defendant, the mortgagee, and the non-party-mortgaged agricultural cooperative with respect to the above land at will without the victim's consent.

2. The Defendant, on February 24, 201, embezzled in relation to the creation of divided superficies with the victim under a title trust agreement with the victim E on February 2, 2002, kept the land of the said four parcels of land on November 26, 2002, including F, G, H, H, and I, 2,195 square meters, G, H field 879 square meters, H field 879 square meters, and I prior to 317 square meters, for the victim on the land of the said four parcels of land.

In respect of the land of the above four parcels at will without the victim's consent from the Namyang District Court in the Namyang District Court stated in the port, the construction and ownership of the electric structure for the purpose (transmission Line) and the total rent for the superficies duration 56,027,540 won shall be 20,451.
