The defendant shall pay 32,159,635 won to the plaintiff.

Costs of lawsuit shall be borne by the defendant.

Paragraph (1) may be provisionally executed.

On December 7, 2017, the Defendant promised to pay a bid bond within 30 days from the date when the cause for devolving a bid bond occurs, such as where the cause for devolving a bid bond arises after bidding instead of being exempted from a bid bond of KRW 5/100,159,635 of the above amount, while participating in the tendering procedure for D Facility Construction executed by the Plaintiff on December 7, 2017, the Defendant promised to pay the bid bond within 643,192,69,635 of the above amount; the Defendant did not enter into the contract with the Plaintiff even though the bid was awarded in the above bidding procedure; and the Plaintiff urged the Defendant to pay the above bid bond on October 21, 2019, the fact that there is no dispute between the parties or that the Plaintiff urged the Defendant to pay the bid bond on October 2

Comprehensively taking account of the above facts acknowledged, the defendant is obligated to pay the above KRW 32,159,635 to the plaintiff according to the contract for the payment of bid deposit. Thus, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
