Punishment of the crime

1. Defendant B

A. A. On April 24, 2016, the Defendant violated the Road Traffic Act (unlicensed driving) driving on the roads of Bupyeong-gu Incheon Bupyeong-gu Bupyeong-gu, Incheon, Bupyeong-gu, without obtaining a driver’s license for approximately KRW 500 meters from the front of the Bupyeong-gu Incheon Bupyeong-gu, to the front of the Incheon Bupyeong-gu, Incheon.

B. On April 24, 2016, the Defendant: (a) around 21:25, the Defendant: (b) thrown away a cigarette butts, which was seated in front of the Incheon Bupyeong-gu, Incheon, while driving the said van on the front of the road; (c) was subject to control by the police officer F belonging to the Incheon Samsan Police Station E zone.

When the Defendant was subject to the control as above, the Defendant proposed that “I will have a driver’s license, change the place of drinking because I had a driver, and changed the place of driving instead of driving a motor vehicle, and changed the police officer’s statement as if I had a driver of the motor vehicle, and made A make a false statement as if I were the driver of the said van.” The Defendant had A make a false statement.

Accordingly, A made a statement to the effect that he/she moved to the driver's seat of the above van at the above date, at the above place, and was driving the above F, so A made a criminal escape by hiding the fact that he/she is a criminal.

As above, the Defendant instigated A to escape a person who commits a crime subject to a fine or heavier punishment.

2. On April 24, 2016, Defendant A received a proposal from B to “to impose a fine, make a statement as if he/she had driven a motor vehicle and asked to do so,” and used his/her consent to make a statement as if he/she driven a Done Star bus.”

The Defendant stated to the effect that he was driving on the road in front of the Incheon Bupyeong-gu, Incheon, and that he was driving a police officer F, who belongs to the Incheon Samsan Police Station E District Unit.

As above, the Defendant had the Defendant escape from B who committed a crime corresponding to a fine or heavier punishment.
