1. The Defendant’s order for the payment of the case to the Plaintiff at the Busan District Court Netcheon-si Court 2015 tea 456.

1.A recognized fact

A. around August 1997, Nonparty B sold the student white paper to the Plaintiff in 12-month installments, which was not repaid by the Plaintiff.

B. The Defendant applied to this court for a payment order under Paragraph (1) of the Disposition No. 1 and the above payment order became final and conclusive on the ground that the Defendant received the above claim against the Plaintiff from the above B.

C. However, the Defendant’s filing date of the above payment order against the Plaintiff is July 25, 2016. If so, it is apparent that the above claim has expired due to the completion of the short-term extinctive prescription of three years.

2. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim is justified.
