1. 특수강도 피고인들과 E은 2014. 6. 16.경 자신들의 유흥비를 마련하거나 채무변제를 위하여 마치 조건만남을 하는 것처럼 가장하면서 남성을 유인한 후 협박하여 금품을 빼앗기로 의논하였고, 그 역할분담은, 피고인 A는 자신의 휴대전화에 채팅 어플리케이션인 ‘즐톡’을 백업받은 후 ‘20대 초반의 여, 12만원 성관계 조건만남’이라는 내용의 글을 게재하고 성매수를 할 남성의 휴대전화를 빼앗으며 협박하는 등 전체적인 범행을 주도하고, 피고인 B은 피고인들이 함께 이동할 차량을 운전하고 E의 남자친구 역할을 하며 피고인 C과 함께 팔에 새겨진 문신을 보여주면서 위력을 행사하고, E은 성매수 남성을 모텔까지 유인한 후 어느 호실에 있는지 알려주기로 하였다.

피고인들은 2014. 6. 17. 02:15경 전주시 덕진구 F에 있는 G모텔 506호실에서, 직전에 고속버스터미널 부근에서 피해자 H(29세)의 승용차를 이용하여 위 모텔로 간 E으로부터 연락을 받고 찾아가, 피고인 B, 피고인 C은 팔에 새겨진 문신을 내보이며 피해자에게 ‘야, 이 씨벌놈아, 미성년자 데리고 뭐하는 거여, 이 좆같은 놈이네, 너 경찰서 가자’라고 말하고, 피고인 B은 ‘걔 미성년자다, 내 여자 친구인데 각오해라’라고 말을 하고, 피고인 A는 '지금 밑에 큰 형님이 기다린다,
