Basic Facts

The plaintiff and the defendant, who are engaged in the construction industry, have been mainly in charge of the plaintiff's non-establishment and dismantling, and the defendant has been in charge of the punishment mold and steel reinforced construction.

With respect to construction works for new multi-households in Chungcheongnam-si, Chungcheongnam-do and Sejong Special Self-Governing City D (hereinafter referred to as the “Sympis of this case”), Chungcheongnam-do and Sejong Special Self-Governing City (hereinafter referred to as the “Sympis of this case”), Chungcheong E and F (hereinafter referred to as the “Sympis of this case”), the Defendant was awarded contracts from the building owner for construction works for new construction works for each multi-households of housing in Chungcheongnam-gu, Chungcheongnam-do, and Sejong Special Self-Governing City (hereinafter referred to as the “Sympis of this case”).

In the case of this case, 8 multi-households with the same structure and area were newly constructed at the location of the same 4th floor. The area of each 1st floor was 12.96 square meters, 172.74 square meters for each 172.74 square meters, and 172.18 square meters for each 4th floor.

In the instant field, two multi-households with the same structure and the same area were newly constructed on the ground that the area of each 1st floor was 82.56 square meters, the area of each 1st floor was 136.31 square meters, and the area of 4th floor was 138.96 square meters.

On May 2013, the Plaintiff was subcontracted from the Defendant on May 2013, to KRW 110,00 per square meter the steel processing and assembly, concrete strawing and external raining construction of the building among the 8 roads of the instant area, and the two roads of the instant area of the said area, and the construction cost equivalent to the area of one story per square meter, based on concrete strawing up to 110,000 per square meter. However, with respect to the construction of the 1st floor of the instant area, the Plaintiff calculated the construction cost corresponding to the area of one story.
