1. The defendant shall be the plaintiff.

1. Determination as to the cause of claim

가. 인정사실 1) 원고는 2012. 2. 29.경 피고와 사이에 별지 목록 기재 건물 중 별지 도면 표시 , , , ㄹ, ㅁ, ㅂ, 의 각 점을 순차로 연결한 선내 ㈎ 부분 120㎡(이하 ‘이 사건 점포’라 한다

(1) A lease agreement under which the Defendant is to lease the lease deposit amount of KRW 10,000,000 for monthly rent of KRW 1,100,000 (payment on March 9) and by March 9, 2014 (hereinafter “instant lease agreement”).

2) On March 9, 2012, the Plaintiff received 2 million won as down payment from the Defendant on the date of concluding the said lease agreement, and around March 9, 2012, 9 million won as the remainder of the lease deposit and the monthly rent, and at that time, transferred the instant store to the Defendant.

3) Since the Defendant paid the above KRW 9 million to the Plaintiff, the Defendant occupied and used the instant store without paying the monthly rent to the Plaintiff. On June 25, 2012, the Plaintiff notified the Defendant of the termination of the instant lease on the grounds of overdue rent. (iv) Meanwhile, the Plaintiff agreed from the Defendant that the former lessee’s business report remains in the instant store and the Defendant’s business report procedure was delayed, and exempted the Defendant from monthly rent for one month.

B. According to the above facts of recognition, even after the Defendant was exempted from paying on April 9, 2012, the same year as of May 9, 2012.

6. 9. The failure to pay the monthly rent as agreed upon in each of the parties, which led to the amount of the delayed rent to reach the amount of two rents. [The period during which the Defendant is obligated to pay the monthly rent to the Defendant (the period ranging from March 21, 2012, even if the period ranging from March 21, 2012, which the Defendant reported on the instant store was counted from March 21, 2012) is more than that of June 21, 2012.
