Reasons
Punishment of the crime
The defendant is the Director D in charge of the C Trade Union.
1. On May 10, 2013, the Defendant violated the Assembly and Demonstration Act, around 16:50 on May 10, 2013, opened a road in front of the F head office located in Seocho-gu Seoul, Seocho-gu, with approximately 700 non-regular workers union members who were punished for long-term old-age farming together with the F Workers union members who are in a large amount of sound to use micro and spackers, and opened a road in front of the F Head office by leaving the place where the assembly was reported by spam.
As a result, there was a danger of public order by infringing the legal interests of others, such as the full impossibility of moving vehicles that use the road in front of the F head office.
Around 17:04 on the same day, the Defendant requested voluntary dispersion to the effect that the head of the above police station guard station ordered by the head of the Seocho-gu Seoul police station using a broadcasting vehicle “I request voluntary dispersion upon the order of the head of the Seocho-gu Police Station. I immediately dissolve it at present. I may immediately be dissolved in violation of Article 6(1) of the Assembly and Demonstration Act. I will request voluntary dispersion pursuant to Article 20(1) of the same Act. I will request voluntary dispersion from 17:1 on the same day, and from 17:1 on the same day, the head of the Seocho-gu Police Station will issue a request for dispersion to many union members on the order of the head of the Seocho-gu Seoul Police Station from 17:1 to 17:1 on the same day. Various minutes are proceeding in violation of Article 6(1) of the Assembly and Demonstration Act. I immediately dissolve the order to dissolve pursuant to Article 20(1) of the same Act to the effect that “I will immediately dissolve and immediately dissolve during the weekly period.”
2. On May 10, 2013, the Defendant, at around 17:05 on May 17, 2013, was set down in the vicinity of the Seocho-gu Seoul Metropolitan Seocho-gu, the Defendant, along with the participants in the assembly.
