Reasons
1. Details of ruling;
A. On April 26, 2012, the head of Songpa-gu Seoul Metropolitan Government publicly announced the authorization to implement the “B district Housing Redevelopment Improvement Project” pursuant to Article 28(4) of the former Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (Amended by Act No. 11690, Mar. 23, 2013)

The Defendant, who is the project implementer of the Seoul Metropolitan City Land Tribunal, filed an application for adjudication in order to acquire the land to be expropriated in Songpa-gu Seoul Metropolitan Government (hereinafter “instant land to be expropriated”) owned by the Plaintiff, which is necessary for implementing the said rearrangement project. On March 22, 2019, the Seoul Special Metropolitan City Land Tribunal: (a) made an application for adjudication to compensate for losses with respect to the instant land to be expropriated, 5,396,850,000 won (=10,050,000 square meters x 537 square meters x 537 square meters); (b) determined the commencement date of expropriation as May 10, 2019 (hereinafter “instant adjudication of expropriation”).
C. On December 19, 2019, the Central Land Expropriation Committee filed an objection against the instant adjudication on expropriation. On December 19, 2019, the said Central Land Expropriation Committee rendered a ruling to convert the compensation for losses to KRW 5,557,305,60 (=10,348,800 square meters x 537 square meters x 537 square meters) of the instant land to the compensation for losses (hereinafter “instant adjudication”).
