1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Details of the disposition;
A. 1) The Plaintiffs are Kimcheon-si E 4,659 square meters (hereinafter “instant land”).
(2) The F Co., Ltd. (hereinafter “F”) is a project implementer who intends to construct multi-family housing, roads, etc. in the area of 132,188 square meters (hereinafter “the instant land”) including the instant land in Kimcheon-si, Kimcheon-si.
B. Determination of an urban management plan and notification of topographic drawings, etc. as of March 10, 2016 under the National Land Planning and Utilization Act (hereinafter “National Land Planning Act”) to the Defendant on March 30, 2015.
(2) Based on Article 26(1), the Defendant issued a notice to the F on May 1, 2015, following the Kimcheon City Urban Planning Committee to submit an urban management planning draft document, including the submission of a land use plan, infrastructure, population plan, and a plan for neighborhood living facilities inside and outside of the complex, with the consent of the land owners corresponding to at least 2/3 of the area of the land subject to the instant project (general residential area No. 2 in the natural green belt area) and a district unit planning zone (multi-family housing, detached housing site, road, green belt, etc.).
3) On September 2, 2015, F submitted to the Defendant a draft document of an urban management plan (district unit planning) regarding the entire area of the instant project site. On March 10, 2016, upon delegation from the Gyeongbuk-do Governor, the Defendant decided on the urban management plan regarding the designation of a district unit planning zone and the formulation of a plan with regard to the instant project site as a site for multi-family housing, etc., and publicly announced the topographic map (H of the Gimcheon-si and hereinafter “the initial notification”).
(c) The F is deemed to lack the feasibility of a project if the content of the initial announcement is consistent with the urban management plan and the topographic map, etc. issued on July 14, 2016.
