The prosecution of this case is dismissed.

On October 18, 2018, at around 20:40, the Defendant, under the influence of alcohol, assaulted the victim D (ma, 63 years of age) who passed around the world of Seo-gu, Daejeon without any justifiable reason, and assaulted the victim by shouldering the victim's face about 10 times.

Judgment

The facts charged of this case are crimes falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act.

On June 11, 2019, after the prosecution of this case, the victim withdrawn his wish to punish the defendant.

Therefore, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
