1. The Plaintiff:
A. Defendant A’s KRW 82,757,859 and for this, KRW 5% per annum from July 23, 2013 to July 17, 2014.
Reasons
1. Basic facts
A. The location of the building and the occupation status (i.e., D’s 1 and 2 above-ground factories are owned by E. F around June 1, 2012. From E to E on June 1, 2012, the F engaged in a synthetic fiber manufacturing business with the name of “G” at the same place. E, among the above factories, engaged in freezing machinery equipment business, etc. in the name of “H” in the name of “H.”
(A) Of the foregoing factories, the first and second units of the instant building are “H building.” Doshe owns approximately KRW 2,300 square meters of the first ground, which is adjoining to the instant building and H building, and the Defendant Limited Company C (hereinafter “Defendant Company”) leased approximately KRW 727 square meters of the said warehouse (hereinafter “Defendant Company”) around March 20, 2013, and carried out a signboard manufacturing business, etc. at that place.
B. (i) The Defendant Company had Defendant B, an executive director, color the construction business operator in order to carry out the construction of office and expansion of entrance and exit in the Defendant Company’s warehouse (hereinafter “instant construction”). Defendant B, introduced by K, requested Defendant A to do the said construction.
Shebly, around 11:30 on April 10, 2013, Defendant A cut the left side panel of the entrance door of the warehouse of the Defendant Company, and during the process of using the stity stike in order to fix the cut panel, fire was generated in the above warehouse, and the stikes gradually expanded in the length, and both the instant building and H building were destroyed as well as the said warehouse.
(hereinafter referred to as “the instant fire”. Article 493,756,409 won in the amount of damages suffered by F as the machinery and movable property of G were destroyed by the instant fire, and Article 100,515,737 won in the amount of damages suffered by E as the instant building was destroyed by the destruction of the said building (346,307,237 won in combination with H building and its internal collection expenses, and movable property damage).
Each of the above amounts is calculated by a certified damage adjuster entrusted by LIG, and the Gwangju District Court Branch Branch of the District Court on 2014.
