1. The plaintiff's claim is entirely dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. (1) On December 31, 2014, the Plaintiff entered into a sales contract with Defendant B to purchase a F land of 764 square meters and the building on the ground thereof in the amount of KRW 820 million, but the down payment of KRW 60 million was to pay the intermediate payment of KRW 140 million on January 30, 2015, and the remainder payment of KRW 620 million on June 20, 2015. (2) On December 31, 2014, the Plaintiff purchased from Defendant C the land of G land of 690 square meters in the Chungcheongnam-gun, Chungcheongnam-do, Chungcheongnam-do, and KRW 810 million in the purchase price; and the down payment of KRW 60 million in the intermediate payment of KRW 160 million in each of the intermediate payment of KRW 30 million in the contract; and (3)00 million in the remainder of KRW 160 million on June 20, 2015.
3) On December 31, 2014, the Plaintiff intended to sell each of the land and buildings owned by Defendant B, C, and D with the land of H 705 square meters and its ground (hereinafter “each of the instant real estate”).
(B) The purchase price of KRW 820 million was purchased, and the down payment of KRW 70 million was concluded on December 31, 2015, and the remainder payment of KRW 130 million was to be paid in June 20, 2015. B. On December 31, 2014 and January 12, 2015, the Plaintiff paid the down payment (total KRW 200 million) of each of the above sales contracts to the Defendants. Defendant E is a licensed real estate agent of each of the above sales contracts. In order to expand and move a factory while operating a factory which manufactures tools and a dives, the plaintiff is considered to have a new factory in order to expand and move the factory.
The plaintiff tried to purchase the manufacturing factory located in the industrial area or the completion business area due to the relationship between noise and dust.
