1. Defendant C Co., Ltd.: (a) KRW 40,197,126 on the Plaintiff and 5% per annum from October 24, 2015 to February 8, 2017.
Reasons
1. Basic facts
A. In relation to the registration, the Plaintiff completed the registration of ownership transfer for reasons of sale on March 10, 2015 and completed the registration of ownership transfer for the trust in the name of KB Real Estate Trust Co., Ltd. (hereinafter “KB Trust”) on the same day, after completing the registration of ownership transfer for reasons of sale on March 10, 2015, and the same year.
8. After completing the registration of ownership transfer based on the trust property attribution, the registration of ownership transfer based on trust was completed on the trust in the future on the same day.
B. On March 10, 2015, the Plaintiff: (a) between KB Trust and the instant real estate, and (b) Nos. 101, 401, 401, 402, 501, 502, and 601, both of the instant real estate and the instant real estate (hereinafter collectively referred to as “instant real estate”).
(2) On August 28, 2015, the Plaintiff entered into a real estate security trust agreement with the trustor, trustee, or KB trust with the content that the trustor actually continues to possess and use the instant real estate, etc., and that the trustor bears all of the actual management activities, such as the preservation, maintenance, repair, etc. of the instant real estate, etc., and that the Plaintiff bears all of the expenses incurred therefrom. (2) On or around August 28, 2015, the Plaintiff entered into a real estate security trust agreement with the trustor, trustee, with respect to the instant real estate, etc., with the content that the trustor shall actually continue to possess and use the instant real estate, etc., and that the trustor shall bear all of the expenses
C. Defendant C Co., Ltd. (hereinafter “Defendant Co., Ltd”) occupied and used the instant real estate from February 5, 2015 to November 8 of the same year.
The monthly rent from February 5, 2015 to November 8, 201 of the instant real estate is KRW 3,890,000, and the Defendant Company is a foreigner.
