The defendant shall be innocent.

1. The Defendant is the president of the D clan, and around 11:00 on March 29, 2012, the Defendant held a general meeting of the above clan in Seongdong-gu Seoul, Seongdong-gu, Seoul, to vote on the agenda, such as the sale of the land owned by the above clan. On the 19th day of the same month, 30 employees of the clan N, N, and Security Service, who were in charge of the general assembly security service, for the reason that there is a concern that the above clan might interfere with the progress of the general meeting due to the suspension of qualification for the clan members, HH, I, J, K, L, and M, who were subject to the said clan from the above clans on the 19th day of the same month, prevented the victims from entering the general meeting at the entrance of the above place, and interfere with the victims from exercising their right to attend and speak as members of the victims.

2. According to the evidence presented, the defendant, as the chairperson of the D clan (hereinafter "the clan of this case") at the time of opening the general meeting as stated in the facts charged (hereinafter "the general meeting of this case"), restricted the participation of the above general meeting of G, H, I, J, K, L, and M (hereinafter "G, etc."), and accordingly, prevented the employees of the N and Security Enterprise from entering the general meeting of G, etc. until the general meeting of this case is opened; due to the above measures, some of G et al. were admitted to waive the participation of the general meeting.

However, according to the records, the clan Council of this case, on March 19, 2012, before the general meeting of this case was held, on the grounds that there were disciplinary reasons such as the annexed list of disciplinary actions against G, etc., such as the list of disciplinary actions, and Article 33 (See Section 3 of the attached list of disciplinary actions) appears to be the only provision concerning disciplinary action against the members of the clan of this case among the rules of this case. The above provision can be subject to disciplinary action against the members of the clan in certain cases.
