1. The plaintiff's primary and conjunctive claims are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. As a certified judicial scrivener, Defendant B is a member of the Damage Compensation Mutual Aid Association operated by Defendant Korean Certified Judicial Scriveners Association (hereinafter “Defendant Association”) with the deduction amount of KRW 200 million, and the Defendant Association is a juristic person operating a mutual aid project to guarantee liability for damage compensation when a certified judicial scrivener inflicts property damage on his client by intention or negligence in performing his/her duties.

B. The Plaintiff’s agreement of payment in kind and the claim for ownership transfer registration are 1) CY reconstruction and rearrangement project association (hereinafter “instant association”)

(2) On April 28, 2008, the instant association entered into a contract for construction in the way that “The instant association provides land owned by the instant association in Gangseo-gu, Seoul and six lots, and is supplied with 22 E apartment units newly constructed in return for the supply of land to the instant association between the instant association and the building association established under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents to implement a reconstruction project on the land of Gangseo-gu, Seoul and 6 lots of land. The construction of the instant association is supplied with 22 households of the instant apartment units newly constructed in return for the provision of land necessary for the instant land provided by the instant association and the construction of the building facilities, and the remaining 14 households shall be sold in general to the instant association and appropriated for the construction cost and the project expenses.”

3) The Plaintiff is a subcontractor for the outstanding construction works of the Jinjin Construction, and among 14 households, the general sale price of which was 290 million won, the general sale price of which was 290 million won (hereinafter “the apartment of this case”) was 201, which was 14 households under the instant construction contract from the Jinjin Construction.

B The payment for the subcontract price of 297,000,000 won for the due construction is to be received, and the apartment sale contract is to be made.
