Punishment of the crime

The Defendant is the representative of the council of occupants' representatives of the complete-gu D Apartment-gu Seoul Metropolitan City, Jeonju-si, who operates multi-family housing management business using 13 full-time workers.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and all other money and valuables within 14 days after the cause for such payment occurred, unless the parties have agreed to extend the fixed date;

Nevertheless, the defendant is working as the chief management officer from February 1, 2012 to January 31, 2014 at the above workplace.

The retired E's unpaid annual paid leave allowance of 901,580 won was not paid within 14 days from the date of retirement without an agreement between the parties on the extension of the due date.

3. The Defendant, as the representative of the council of occupants' representatives of the complete-gu D apartment in the Jeonju-si, is an employer who operates a collective housing management business using 13 full-time workers.

When a worker retires, the employer shall pay retirement allowances within fourteen days from the date when the cause for such payment occurred, unless otherwise agreed by the parties concerned relating to the extension of the due date.

Nevertheless, the defendant works in the above workplace from December 1, 2005 to June 30, 2014.

The date of payment shall be 4,909,258 won, including 1,519,983 won of retirement allowance of retired FF, as shown in the separate list of crimes.
