A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. 상해 피고인은 2017. 2. 26. 00:25 경 고양 시 일산 동구 무궁화로 20-28에 있는 ‘ 장항동 제 4 공 영주 차장’ 앞 도로에서 피해자 C(44 세 )으로부터 “ 조 센 징 니들이 뭘 알아, 이 개새끼들 아” 라는 말을 듣게 되자 화가 나, 주먹으로 피해자의 얼굴 부위를 수회 때리고, 피해자가 바닥에 넘어지자 계속해서 발로 피해자의 얼굴 부위와 몸통 부위를 수회 때려 피해자에게 약 3 주간의 치료를 요하는 요추의 염좌 및 긴장 등의 상해를 가하였다.

2. 공무집행 방해 피고인은 제 1 항 기재 일시, 장소에서 “ 사람들이 심하게 싸운다” 는 112 신고를 받고 출동한 일산 동부 경찰서 D 지구대 소속 경찰관인 E으로부터 C에게 폭행을 가하는 것을 제지 받자, E에게 “ 이런 씨 발 짭새 새끼야, 어디서 죽을라고

Accordingly, the defendant interfered with legitimate execution of duties concerning reporting and handling duties by police officers.
