A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On June 23, 2016, the Defendant was sentenced to two months of imprisonment and ten months of imprisonment for fraud, etc. at the Incheon District Court, and completed the execution of the sentence on April 9, 2017.

1. Around 22:00 on April 12, 2017, the Defendant issued an order for food, etc. with the victim C, who did not have the intent or ability to normally pay the price even if the victim was provided with food, etc., on the part of “E” operated by the injured party in Dong-gu Incheon Metropolitan City, Dong-gu.

Ultimately, the Defendant, by deceiving the victim as above, was provided with the 15 Mad Co., Ltd. (75,000 won), Han-ju (25,000 won), Han-ju (25,000 won), and Sing Services (20,000 won).

2. Around 22:00 on April 23, 2017, the Defendant ordered food, etc. using the “H main store” table No. 1 operated by the injured party in Nam-gu Incheon Metropolitan City G, and the facts, even if being supplied with food, etc., did not have the intent or ability to normally pay the price to the injured party. As such, the Defendant ordered food, etc. as if the injured party would normally pay the price to the injured party.

Ultimately, the Defendant, as above, by deceiving the victim as above, received from the injured party the 160,000 won in total from the seat, i.e., KRW 110,00 ( KRW 110,000), KRW 5 Byung(25,00) and KRW 25,00 in Ansan( KRW 25,00).

3. On April 23, 2017, around 23:50, the Defendant ordered food, etc. to the victim I, even though he was provided with food, etc., the Defendant did not have the intent or ability to pay the price normally. However, the Defendant ordered food, etc. to the victim as if he would normally pay the price to the victim.

Ultimately, the Defendant deceivings the victim as above, and up to 140,000 won in total from the victim, namely, 110,000 won in seats, 1 Byung (10,000 won), 1 Byung (5,000 won), and 1 Aju (25,000 won).
