A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 4. 20. 22:45경 대전 유성구 C빌라 302호 피고인의 주거지 원룸 내에서, 피해자 D(여, 18세)이 술에 취해 침대에 누워있는 모습을 보고 욕정을 느껴 피해자에게 다가가 강제로 키스하면서 상의 속으로 손을 넣어 피해자의 가슴을 만지고, 피해자의 바지를 벗기려고 하자 피해자가 “하지 마.”라고 하면서 바지를 손으로 잡는데도 강제로 피해자의 바지와 팬티를 벗기고 피해자의 음부를 입으로 빤 후 피해자의 몸 위에 올라타 피해자의 의사에 반하여 피고인의 성기를 피해자의 음부에 삽입하여 간음하였다.
