A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year and six months from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 26, 2015, the Defendant purchased 2 vehicles in the name of the Defendant in the name of “C” located in the Busan annual system B, the Defendant was granted a financial loan from the victim Matts Capital Co., Ltd. to KRW 10 million in the purchase price for the said vehicle.

In accordance with the above installment financial agreement, the Defendant agreed to repay the principal and interest of loans each month between March 21, 2015 and March 36, 2015, and as a security, the Defendant set up a collateral security interest of KRW 10 million for the above cargo vehicle to the victim company.

Nevertheless, on February 2016, the defendant extended a loan of KRW 2 million to a person who is unable to know his name at the defendant's home located in Busan Jin-gu, Busan, and delivered the above cargo vehicle at the underground parking lot at that place and obstructed the victim's exercise of rights.
