1. Facts of recognition;

A. The Plaintiff Ulsan Special Cargo Co., Ltd. (hereinafter “Plaintiff Co., Ltd.”) is a company engaging in the special vehicle transport business, cargo brokerage business, etc. at the location of its principal office. Plaintiff A purchased D-Tank Vehicles (hereinafter “Plaintiff”) and entered into the Plaintiff Co., Ltd. in the name of B.

B. On May 11, 2012, at around 03:35, Defendant C driven a vehicle owned by the E-vehicle (hereinafter “Defendant Company”) by Defendant Substitute Trucking Trucking Company (hereinafter “Defendant Company”) and operated a two-lane on the two-lane road at the YY YY YY YY YY YY YY, the vehicle was destroyed by the front part of the Defendant Company and the fire was partially damaged. The Plaintiff’s vehicle was partially damaged due to the instant accident.

C. After the instant accident, the Plaintiff Company received KRW 17,594,180 from the Korea Trucking Business Mutual Aid Association, which was affiliated with the Defendant’s vehicle, for the repair cost of the Plaintiff’s vehicle.

2. Occurrence of liability for damages;

A. According to the facts of the judgment as to the cause of the claim, the defendant C neglected the duty of care in front while driving the defendant vehicle and caused the accident of this case that conflict with the plaintiff's vehicle owned by the plaintiff A. Thus, the defendant C and its employer are liable for compensating the plaintiffs for the damages caused by the accident of this case, and the defendants are in in an in personam joint and several relationship.
