A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In using and managing a means of access, no one shall borrow or lend a means of access, or keep, deliver or distribute a means of access, in receiving, demanding or promising compensation, unless otherwise expressly provided for in any other Act.

1. On June 19, 2019, the Defendant: (a) divided conversations between name-free persons and telegrams; (b) obtained a proposal and consented to make a loan by creating a transaction statement with the passbook and making an OTP card; and (c) completed the registration of “B” in the North Korean Mine Co., Ltd. located in the 70-gu, Gwangju Northern District on June 20, 2019; and (d) opened the E Association account (F) in the name of the said company in the name of the said company at the D Association located in the Seoul Northern-gu, Gwangju District on July 19, 2019; and (e) notified Kwikset-gu, Seocheon-gu, Seocheon-gu, Seoul, with the means of access to the said company’s account to Kwikset-gu’s name-free article, head of the passbook card, and head of the OT card and password card; and (e) notified the means of access to the Internet.

2. The Defendant, on June 2019, received and consented to the proposal as above from the non-member of the name, and thereafter, on June 24, 2019, completed the business registration of “G” in Seogju Tax Office located in Seo-gu, Seo-gu, Gwangju, Seo-gu, Gwangju, with the business democracy 6-gil 31, and opened an enterprise bank account (H) in the name of the said company at the location of the IBK Bank branch located in the 240-gu, Gwangju, Gwangju, at the 240-gu, Gwangju, and on July 2019, lent the means of access to the Kwikset service provider, which was related to the said account, from the Hancheon-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu.
