A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The defendant is a person who is engaged in driving a cuss car in D.

On November 25, 2015, the Defendant driven the said car without a mandatory insurance without obtaining a driver’s license of the said car, and led to a two-lane road adjacent to the agricultural cooperative city in Pyeongtaek-si-dong, from the direction of the Pyeongtaek-si Police Station to the traffic 40km each hour at a speed of about 40km.

At the time, at night and at the front, there was a private-distance intersection with signal apparatus installed, so there was a duty of care to see a person engaged in driving of a motor vehicle in front and safely drive the motor vehicle in accordance with the signals and prevent the accident in advance.

Nevertheless, the Defendant neglected this and neglected to turn to the right-hand turn from the opposite side by negligence of the red signal, and received the front part of the FK7 car driving in the FK7 car from the opposite side of the victim E(29) as the front part of the Defendant’s vehicle.

Ultimately, the Defendant suffered injury to the victim, such as a scard salt fright, which requires a two-day medical treatment due to the above occupational negligence, and at the same time escaped without taking necessary measures, such as immediately stopping and aiding the damaged party, even though the said K7 car is damaged by the replacement of the front offender, etc., and thereby damaging approximately KRW 3,697,582 of the repair cost.
