Reasons
1. Determination on the legitimacy of a subsequent appeal
A. On July 1, 2014, the Plaintiff filed an application for an order for payment against the Defendant for compensation for damages due to nonperformance of a real estate right transfer contract (Sacheon District Court 2014 tea6713), and entered the application for the order for payment as “49,1 stories (Sacheon-gu Open Port) (Sacheon-gu), the Defendant’s address as the principal office is located. The foregoing court sent the original copy of the order for payment to the above address, but was not served as the addressee or the addressee’s absence. On September 24, 2014, the Plaintiff was performing the litigation (Sacheon District Court 2014GaGa65747) upon the Plaintiff’s application for the payment order by the first instance court (Sacheon-gu District Court 2014Ga65747). B, the Defendant’s office clerk (employee) received it on November 2, 2014.
3) On April 10, 2016, the first instance court: (a) deemed that the Defendant was unable to submit a written response; and (b) determined the date of the judgment without pleading, and revoked it, and served the Defendant with the notice of the first date of pleading, the notice of the second date of pleading, and the notice of the date of pronouncement, but the service of the notice was impossible on the grounds of the addressee’s absence; (c) the first instance court served the notice by means of delivery, as the delivery was made; (d) on January 30, 2015; (e) on March 20, 2015; and (e) on April 10, 2016, the first instance court proceeded with the first and second date of pleading while the Defendant was absent, and served the original copy of the judgment to the Defendant on April 23, 2015, but was not served on
5) On August 12, 2016, after the expiration of the appeal period, the Defendant filed an appeal for subsequent completion on August 12, 2016.
