1. 특수상해, 특수재물손괴 피고인은 2018. 10. 6. 20:15경 B 그랜드체로키 승용차를 운전하여 경주시 C 근처에 있는 편도 1차로의 도로를 D 삼거리 쪽에서 D 주차장 쪽으로 진행하던 중, 같은 차로에서 피고인의 승용차를 따라 진행 중이던 피해자 E(36세) 운전의 i40 승용차가 중앙선을 넘어 자신의 승용차를 추월하였다는 이유로 위 i40 승용차를 뒤따라 진행하면서 5회에 걸쳐 상향등을 깜빡거리고, 경적을 길게 울리고, 위 i40 승용차의 좌측으로 위 그랜드체로키 승용차를 가까이 붙여 진행하다가 갑자기 핸들을 오른쪽으로 꺾는 방법으로 위 i40 승용차의 좌측면부를 피고인 운전의 위 그랜드체로키 승용차 우측면부로 충격하여 피해자 F에게 약 2주간의 치료가 필요한 요추의 염좌 및 긴장의 상해를, 위 i40 승용차에 탑승하고 있던 피해자 G(여, 37세)에게 약 2주간의 치료가 필요한 엉덩이의 타박상 등의 상해를, 같은 피해자 H(7세)에게 약 2주간의 치료가 필요한 대퇴의 타박상의 상해를, 같은 피해자 I(남7세)에게 약 2주간의 치료가 필요한 엉덩이의 타박상 등의 상해를 각각 가함과 동시에 피해자 J 소유인 i40 승용차를 프론트 펜더 교환 등 수리비 약 1,974,348원이 들도록 손괴하였다.
