1. The Defendant shall pay to the Plaintiff KRW 37,186,90 and the interest rate of KRW 19% per annum from May 1, 2010 to the day of complete payment.
Reasons
1. Facts of recognition;
A. The Plaintiff entered into a comprehensive implementation contract with the non-party-party-party-Dongdong-gate F reconstruction Business Association (hereinafter “instant association”) which promoted a market reconstruction project on the size of 4,144.3 square meters in Jung-gu, Seoul and Jung-gu, Seoul, Seoul, which is the land for the Dongdaemun-gu market and D market, on an overall implementation contract for the new construction of the “G commercial building,” and then leased and sold the said new commercial building (hereinafter “instant commercial building”).
B. On November 19, 2007, the Plaintiff and Nonparty H entered into a lease agreement with respect to the second floor of the instant commercial building on the following terms:
[G Rental Contract] Article 1 (Indication of Rental Real Estate) (1) The subject real estate is as follows:
The target store: The 2nd floor unit (the exclusive use area of the Gu unit: 3.9 square meters) and the scheduled date of occupancy of women's clothes: December 2, 2009 (it may be changed according to the process, and the period of occupancy).
(3) After drawing a store, a direct lease contract with a lessor is prepared, and such sales contract becomes void after drawing up a new lease contract, and a relationship with a lessor shall be governed by a new lease contract.
Article 2 (Payment of Price) (1) The following rent out of the rent shall be as follows, and where there is an increase or decrease in the area after the drawing of a store, the final settlement shall be made pursuant to Articles 4 and 5, and additional taxes shall be separately imposed:
(2) The sale price of KRW 79,50,000, 000, excluding rental deposit of KRW 118,000,000, excluding rental deposit of KRW 38,500,000.
25,190,00 won at the time of the contract of down payment, the first intermediate payment in December 2007, the second intermediate payment in July 2008, the third intermediate payment in July 2008, and the fourth intermediate payment in December 2008, each of 18,892,500 won at the time of the contract of down payment, and the remainder in October 25, 2009, the amount of 19% per annum.
