피고인은 C, D, E, F, G, H과 함께, 2013. 3. 26. 11:00경 강원 양양군 I 및 J 부지에 있는 개인 사찰인 피해자 K(법명 L)과 피해자 M(법명 N)이 주거로 사용하는 O 앞에 이르러, 위 사찰을 점거할 목적으로 잠겨 있지 않은 문을 통하여 그곳 요사채(寮舍, 승려들이 식사를 마련하는 부엌과 식당, 잠자고 쉬는 공간을 통칭함) 안까지 들어가 피해자들의 주거에 침입하였다.
