1. The Defendants jointly share KRW 24,497,091,640 among them and KRW 1,006,712,800 from July 2, 2005 to KRW 1,947,843.
Reasons
1. Facts of recognition;
A. Although Defendant A, who established and operated a C/C convalescent hospital, is not a medical person, the Defendants’ establishment and operation of the C/C convalescent hospital cannot be a medical institution. However, around 2004, the Dongjak-gu Seoul Metropolitan Government Investment a total of KRW 1.4 billion from Nonparty F, one of whom he/she had known through F, in the name of using it for the hospital business, and paid the lease deposit for the building, the hospital interior Corporation, and the purchase of medical appliances, and the Nonparty G, who is a doctor, used it for the hospital’s purchase from July 1, 2004 to May 1, 2005, and from May 21, 2005 to February 21, 2007, Nonparty I, a doctor, received a total of KRW 1.5 billion from Nonparty F, who was in charge of the pertinent hospital’s management from February 222, 2007 to May 21, 2007.
In addition, from July 1, 2004 to May 2013, Defendant B contributed to the operation of the hospital and the increase of revenues by exercising overall control over administrative affairs related to the operation of the hospital, and participating in personnel management, fund management, etc.
B. From July 1, 2004 to May 1, 2013, Defendant A, who received medical care benefits from the Plaintiff, employed the above G, H, and I, had many unspecified patients conduct medical treatment. In relation to the treatment, Defendant A claimed medical care benefit costs under the National Health Insurance Act with regard to the treatment, and the Plaintiff paid KRW 24,497,091,640 in total to the account managed by Defendant A as follows.
