A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
On November 5, 2010, the Defendant was sentenced to two months of imprisonment for a crime of fraud in the Changwon District Court’s territorial branch, and completed the execution of the sentence on January 12, 201, and on December 13, 2012, the Defendant was sentenced to one year of imprisonment for a crime of fraud in the Daegu District Court’s Kimcheon Branch, and the judgment became final and conclusive on December 21, 2012.
1. Around August 2012, the Defendant was aware of the victim B and smartphone program, which was a “hon,” and he was aware of the fact that he was a foreigner who acquired the permanent residence of the United States, and that he was in office as a planning-oriented team agent from Samsung F&M display to acquire property or property benefits from the victim.
Around August 20, 2012, the Defendant made a false statement to the victim, stating, “The Defendant lost a wall, which is urgently needed. It shall be repaid after one month.”
However, there was no fact that the defendant was not a foreigner but a Korean person, and he was working for Samsung F&M.
As above, the Defendant, by deceiving the victim as above, received KRW 150,00 from the Agricultural Cooperative Account (Account Number: E) in the name of the victim, and received KRW 3,68,700 in total from August 20, 2012 to September 26, 2012 through eight times, as shown in the annexed Crime List.
2. Around September 19, 2012, the Defendant: (a) entered into a siren agreement using the victim’s name in the (Y)G located in Seoul Northern-gu, Gwangju; and (b) paid KRW 3,220,000 to the said G using a credit card in the name of the victim for the purpose of compensation after having paid the traffic accident in Seoul Olympic Games; (c) around September 20, 2012, the Defendant paid KRW 2,50,000 out of the said amount from the said G around September 28, 2012 after returning it to the Agricultural Cooperative account in the said name of the said D and kept for the victim.
