A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. On November 15, 2018, around 00:51, the Defendant: (a) placed an order for alcohol and food at a “D” restaurant operated by the victim C in Seo-gu Incheon, Seo-gu, Incheon; (b) placed the order as if the Defendant had no intent or ability to pay the price; and (c) placed an order for alcohol and food to the victim; and (d) had the victim received an order for alcohol and food equivalent to KRW 10,000 from the victim; (b) paid the price.

In addition, from around that time to March 18, 2019, the Defendant was provided with a total of KRW 195,000 and food in five times as shown in the attached crime list.

Accordingly, the defendant was provided property by deceiving the victims.

2. Interference with business;

A. From around 00:51 on November 15, 2018 to 01:21 on the same day, the Defendant d'D' restaurant operated by the victim C in Seo-gu Incheon, Seo-gu, Incheon, which read “D’s operation,” the Defendant spited the victim’s restaurant business by force for about 30 minutes, such as spiting the victim into the restaurant floor and avoiding the disturbance.
