1. The Defendant shall pay to the Plaintiff KRW 63,904,552 and the interest rate of KRW 15% per annum from August 11, 2016 to the date of complete payment.

1. Facts of recognition;

A. On April 21, 2014, the Plaintiff, the owner of each building listed in the separate sheet, entered into a real estate lease agreement (hereinafter “instant lease agreement”) with A (hereinafter “A”) as follows.

(1) Lease object: The whole of the first floor among the buildings listed in paragraph (1) of the attached list and the buildings listed in paragraph (2) of the same list (hereinafter referred to as “the lease part of this case”) (2) lease deposit: 70,000,000 won.

B. A around May 2, 2014, the Plaintiff delivered the instant lease agreement to A, and the said company began to possess and use the instant lease agreement from that time, and A paid electricity charges incurred by the use of the instant lease agreement and the dormitory rent, which is ancillary facilities, to the Plaintiff.

C. A began to be in arrears after June 2014, and the Plaintiff, on July 29, 2014, deducted a sum of KRW 25,394,474, including the rent in arrears, etc., from the lease deposit, and expressed an intention to deduct the outstanding amount after deducting it from the lease deposit.

On the other hand, A was decided on November 25, 2014 by Suwon District Court 2014 Mahap555, and the defendant, the representative director of A, was appointed as the custodian.

E. On February 22, 2015, the sum of rent, electricity, etc. not paid by A until February 22, 2015 reached KRW 70,255,872.

A delivered the lease of this case to the Plaintiff on January 28, 2016.

F. From February 22, 2015 to January 28, 2016, A delivered the instant lease deposit due to the full deduction of the obligation to pay A’s rent, etc. from the lease deposit under the instant lease agreement, the sum of the amount paid by the Plaintiff on behalf of the said company from February 22, 2015 to January 28, 2016.
