A defendant shall be punished by imprisonment for six months.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

Punishment of the crime

No one shall invite a foreigner by improper means, such as a false statement of fact or a false fidelity guarantee, to allow the foreigner to enter the Republic of Korea, or arrange such invitation.

1. The crime of false invitation in the name of B business operator C asked D through the Defendant to make a false invitation to Vietnam under the name of B business operator, and D accepted it.

C Around November 2017, according to the above invitation, a foreigner E (F) of Vietnam’s nationality had entered the Republic of Korea to conduct a market research related to B and to introduce products, as if he/she had entered the Republic of Korea, he/she made a false invitation letter, a false invitation letter, and submitted a false invitation letter to the Embassy of the Republic of Korea located in Vietnam through the Defendant through the Defendant, and submitted it to the Embassy of the Republic of Korea located in Vietnam. From that time to November 2017, 2017, he/she invited six foreigners by fraudulent means, such as a false certificate of personal reference as indicated in attached Table I, and a false invitation letter, to the Embassy of the Republic of Korea located in Vietnam.

Accordingly, the defendant invited a foreigner in collusion with C or D by unlawful means, such as making a false statement or making a false identity guarantee.

2. G (State) Business Operators’ false invitation to Vietnam under the name of G (State) Business Operators’ name and H accepted the false invitation of Vietnam under the name of G (State) Business Operators’ name.

C Around April 2017, according to the above invitation, a foreign I (I, J) of Vietnam’s nationality entered the Republic of Korea to conduct a market research and product introduction related to G (State), a false invitation letter is prepared, a false invitation letter is submitted by the Defendant through H to the Embassy of the Republic of Korea located in Vietnam by unlawful means, such as submission of the foreigner’s personal seal to the Embassy of the Republic of Korea located in Vietnam by obtaining the official seal of H from H, and from November 2017.
