1. Basic facts

A. Defendant Barnet Co., Ltd. (hereinafter “Defendant Barnet”) is the owner and the installer of cash withdrawal CD/ATM device (hereinafter “instant device”) as seen below.

The Defendant Korea Development Bank Co., Ltd. (hereinafter referred to as the “Defendant Korea Development Bank”) is the management main agent of the equipped with the devices of this case at a ion range of ion range of discharge points (hereinafter referred to as the “instant store”).

The Defendant Barun Property Insurance Co., Ltd. (hereinafter “Defendant Barun Property Insurance Co., Ltd.”) is an insurer who entered into a contract with Defendant Barun and its store facilities to compensate for the damages, if any, due to the occurrence of the liability for damages with Defendant Barun and its store facilities.

B. On May 22, 2012, around 21:42, an accident occurred in which A, an employee of the BrazilS Korea Co., Ltd. (hereinafter referred to as “victim”), takes charge of the instant devices installed in the instant store located in Dong-dong, Jung-dong, Daejeon Metropolitan City (hereinafter referred to as the “instant devices”) and takes charge of the instant devices installed in the instant store located in Dong-dong, Jung-dong, Daejeon Metropolitan City (hereinafter referred to as Daejeon Special Metropolitan City), he/she takes charge of the said devices in his/her hands and her left hand in contact with the wall columns on the parts of the devices.

On May 23, 2012, Defendant Barnet’s consignment company, which manufactured and installed the instant devices, visited the instant stores, and confirmed that the instant devices became approximately KRW 70V leakages from the wall columns and floor steel plates of the instant devices, and requested the electric connection construction to the facility team of the Defendant Korea set up.

On May 24, 2012, Defendant Korea Development Bank Co., Ltd.: (a) visited the instant store on May 24, 2012; (b) found that the voltage was not detected in the instant device, but is connected to the multi-modal outlet with no electric source code; and (c) that multi-modal outlet is linked to the contact with the wall at the location of the wall; and (d) found that the multi-modal outlet is linked to the contact with the container at the location of the wall.
