Basic Facts

D A. On January 8, 2008, D Co., Ltd. (hereinafter “D”) entered into a lease agreement with the Defendant on April 4, 401, 402, 403, 409, 412, 416, and 417 (hereinafter “instant real estate”) in Gangnam-gu Seoul, Seoul, with the lease deposit amount of KRW 960,000,000, monthly rent of KRW 40,000 (the Seoul Central District Court Decision 2009Da32312, 6190, 209) for the lease agreement between D and the Defendant for the purpose of increasing the rent of KRW 46,00,00,000 from July 21, 2009 to July 21, 2009 (the lease agreement).

D On December 21, 201, when the lease term of the previous lease contract of this case was under the lease term of this case, the lease deposit of this case between the Defendant and the Defendant shall be maintained as before, but the lease term shall be extended from January 1, 2012 to December 31, 2017, and the lease term shall be extended from January 1, 2012 to December 31, 2017.

The term “the instant lease agreement” stipulated that the lease agreement shall be paid by increasing the amount as indicated below (hereinafter “the instant lease agreement”). Article 1(4) of the instant lease agreement provides that “When a lessee is delinquent in paying the amount to be paid to a lessor under this agreement, the lessee shall pay the amount in arrears calculated by calculating the interest rate in arrears (19% per annum, but 30% per annum, per annum, per annum, per 2 months or more) by the number of days, and the appropriation order shall be in the order of arrears, rent, etc.”
