A shall be punished by imprisonment with prison labor for eight months and by imprisonment for six months.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
The judgment on February 21, 2014 became final and conclusive on September 5, 2013, when Defendant A was sentenced to four months of imprisonment in the Incheon District Court for fraud.
【Criminal Facts】
The Defendants, together with E/F, posted the article that Defendant B sells contact diskettes on the Internet, and Defendant A conspired to receive money by falsely speaking that goods are sold to the victims who reported the above article, and E/F intended to take charge of withdrawing the above remittance amount.
On February 18, 2013, the Defendants posted an article to the effect that Defendant B would sell “J contact pockets” on the Internet Neber I’s website using a computer, and Defendant A made a false statement to the effect that Defendant B would sell KRW 36,000 “J contact pockets” via Kakaoox to the victim K who reported and contacted the above article.
However, there was no intention or ability to sell money even if the Defendants received money from the victims because they did not have a J-Wetet.
The Defendants received 336,00 won from the victim to the account of community credit cooperatives (L) in the name of Defendant B.
By March 17, 2013, the Defendants, in collusion with E and F, received total of KRW 2,066,000 from the eight victims in total under the name of “N” as the victim “M” as stated in the indictment No. 6 of the attached list of crimes by the aforesaid method, because the victim “M” is a clerical error in “N.”
Defendant A, around September 4, 2013, posted a letter "I sell T-mone money (T-mone) to 80,000 won," which read "I will sell the money to 80,000 won," by accessing NAV, which is an Internet used goods transaction site, using smartphones, from the front side of the Bupyeongcheon-si, Seocheon-si, Seocheon-si, Busan, and I will deposit money to the victimO who reported and contacted the above letter.
