1. On June 2, 2015, the Defendant’s corrective order as stated in the attached Table 1 that was issued against the Plaintiff shall be revoked.
2. Of the costs of lawsuit.
Reasons
1. Details of the disposition;
A. The Plaintiff, as the council of occupants’ representatives consisting of representatives from each building among the occupants of A apartment located in Da in Dasan-si (hereinafter “instant apartment”), discussed whether to conclude a re-contract with the Defendant’s Intervenor’s Intervenor’s former North Korea Housing Management Institute (hereinafter “former North Korea Housing Management Institute”) on March 25, 2015, when the period of entrusted management contract expires on December 27, 2013, by the former Housing Management Institute (hereinafter “former North Korea Housing”), the Defendant’s Intervenor’s Intervenor, a housing management operator, held a meeting with 15 of the total members present (hereinafter “Council of Residents’ Representatives, March 25, 2015”), with the consent of 12 of the said 15 members, to proceed with the re-contract procedure in accordance with Article 45 of the instant apartment management rules and the proviso to Article 52(4) of the Enforcement Decree of the Housing Act.
B. On March 30, 2015, the Plaintiff’s Intervenor B, at the time, posted the “written advice on the opinions of the occupants related to the consignment management re-contract” on March 30, 2015 to satisfy the requirements for re-contract as stipulated in the proviso of Article 52(4) of the Enforcement Decree of the Housing Act, and publicly announced that the Defendant’s Intervenor’s Intervenor’s objection to the re-contract with the North Korean Housing may be raised from March 30, 2015 to April 8, 2015, and on April 5, 2015, 285 of the instant apartment resident’s consent was received.
C. After that, on April 13, 2015, the Plaintiff’s Intervenor B, without going through a separate resolution of the council of occupants’ representatives, shall be “the instant bidding” in the multi-family housing management information system to select the housing management operator of the instant apartment.
