1. The plaintiff's primary and conjunctive claims are all dismissed.

1. Basic facts

A. On September 5, 2002, the Defendant entered into a contract with the Defendant for remodeling construction of the fourth floor of the Kimpo Airport International Complex 2nd, and on September 5, 2002, A Co., Ltd. (hereinafter “Nonindicted Company”) entered into a contract with the Defendant to accept a subcontract with the Defendant for construction work with respect to “the construction of the 4th floor B interior and soundproofing Facilities” of the said construction work (hereinafter “instant construction work”), including value-added tax, KRW 1.1 billion for the said construction work (including value-added tax, KRW 30,00,000, KRW 770,000 for soundproof facilities, and KRW 770,000 for soundproof facilities), period from September 5, 2002 to December 31, 2002.

B. On September 5, 2002, the Plaintiff entered into a contract for the repair of defects with the Defendant as the guarantee creditor, and the Plaintiff entered into a contract for the repair of defects with the content that the Plaintiff shall pay the security deposit for defects to the Defendant, the guarantee creditor, when the non-party company received a request for the performance of the repair of defects and the guarantee period from January 1, 2003 to December 31, 2005.
