피고인은 2012. 12. 7. 01:30경 전주시 덕진구 D아파트 206동 501호 집에서, 피해자가 술을 마시고 밤늦게 귀가하였다는 이유로 부부싸움을 하던 중, 피해자가 “또 잔소리를 한다”며 집밖으로 다시 나가려 하자 주방에 있던 부엌칼(칼날길이 16cm , 전체길이 28cm )을 가져와 손에 쥔 상태로 팔짱을 낀 다음 피해자에게 “나 지금 화나 있으니까 나가지 말고 나와 얘기 좀 하자. 밖으로 나가면 칼을 휘두르겠다.”고 말하였으나, 피해자가 이를 무시하고 손으로 피고인의 목과 가슴 부위를 세게 밀치고, “하나도 안 무섭다. 찔러봐라. 찔러, 찔러”라고 말하며 찔러보라는 듯이 상체를 들이밀자 화를 억누르지 못하고 격분하여 피해자를 살해하기로 마음먹고, 위 부엌칼을 양손으로 부여잡고 피해자의 가슴 부위를 1회 힘껏 찔렀다.
