2. The instant case is an offense falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the intent expressed by the victim under Article 260(3) of the Criminal Act.

Since the victim expressed his/her wish not to punish the defendant on September 7, 2016, which was after the prosecution of this case, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 6 of the Criminal Procedure Act.
