1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On August 30, 2002, the Plaintiff, Nonparty C, and D concluded a lease agreement between the Defendant and the Defendant, which set forth the deposit amount of KRW 1,050,000 as to the whole of the first floor, the first floor, the first floor, and the fourth floor of the ground among the building of this case (hereinafter “the building of this case”) newly constructed by the Defendant, at the time of August 30, 2002, on the first floor, the second floor, the second floor, and the fourth floor of the building of this case (hereinafter “the building of this case”). On February 10, 2003, the Plaintiff, C, and D concluded the lease contract between the Defendant and the Defendant on a fixed basis with regard to the lease portion of the instant building (1,050,000,000 won for the contract amount of KRW 100,000,000 for the contract amount of the previous provisional contract shall be substituted by the amount paid at the time of the previous provisional contract, and the remainder of KRW 950,000,000 for the remainder of the contract amount of KRW 950,000,000 for the lease amount of April 2003), and C signed and sealed the lease contract with the lessee as the representative of the lessee.

B. Around March 2003, the Plaintiff, C, and D wished to open a clinic with the trade name “FIBD members” from the above leased part of the instant building. A pharmacy part of the above leased part (hereinafter “pharmacy part”) was established on the condition that G, who was in charge of the interior work of the above leased part, lends KRW 200,000 to the Plaintiff, C, and D with the right to operate the said pharmacy, and the Plaintiff, C, and D, with the Defendant around May 203, 203, newly concluded a lease contract with the Plaintiff and C (each seal), the lease deposit from the existing 1,050,000 to the 1,00,000,000,000 from the above leased part, and the lease deposit from the previous 30,000 to the 305,005,000,000 from the previous 30,000,000 from the previous 30,530,005.
