1. The Defendant:32,350,050 won to Plaintiff A Co., Ltd. and 6% per annum from July 1, 2017 to February 6, 2018.
Reasons
1. Basic facts
A. The Defendant’s husband, from January 2007 to September 30, 2016, D operated the wholesale and retail shop for construction, such as plastic containers (hereinafter “F”) with the trade name “F” in the following cities: (a) from January 2007 to September 30, 2016.
B. As of September 29, 2016, Plaintiff A Co., Ltd. (hereinafter “Plaintiff”) (hereinafter “Plaintiff”) was a company manufacturing and selling net containers, etc., the Plaintiff Co., Ltd. (hereinafter “Plaintiff Co., Ltd.”) supplied de facto containers, etc. to F. that was operated by D, and as of September 29, 2016, the amount of the purchase price for the goods unpaid to D is KRW 42,850,050, but the amount of the purchase price for the goods unpaid to Plaintiff Co., Ltd. is KRW 10,50,000 from December 30, 2016 to June 30, 2017, the amount of the purchase price for the goods unpaid to Plaintiff Co., Ltd is KRW 32,350,050,050.
3) On October 13, 2017, the Plaintiff Company filed a lawsuit against D on the claim for the payment of goods (Seoul Southern District Court 2017Da16925), and on October 13, 2017, the said court rendered a ruling that “D shall pay to the Plaintiff Company the amount of KRW 39,850,050 and the amount calculated at the rate of 6% per annum from November 1, 2016 to September 1, 2017, and 15% per annum from the next day to the day of full payment.” (C) Plaintiff B (1) was a person who manufactures and sells glass containers, etc. with the trade name of Plaintiff B, and supplied D with a contact for construction, such as actual containers, to the FD operated by D until August 31, 2016.
2) As of August 31, 2016, the amount of claims against Plaintiff B for the amount of claims for the amount of goods unpaid to Plaintiff B is KRW 107,474,725, but the amount of claims against Plaintiff B shall be KRW 3,00,00 from November 1, 2016 to November 30, 2016. As of November 30, 2016, Plaintiff B filed a lawsuit against Plaintiff B for the claim for the amount of goods unpaid to Plaintiff B is KRW 104,474,725, and the amount of claims payable to Plaintiff B shall be KRW 104,474,725, and the amount of claims payable to Plaintiff B shall be KRW 104,474,725, and the amount of claims payable to Plaintiff B shall be KRW 63031, Nov. 15, 2017.
