Punishment of the crime
【2012 Highest 3572】 From September 1, 2006 to September 20, 201, the Defendant was in charge of selling and managing parking revenue stamps to students, school personnel, etc. while serving as a staff member in the accounts and staff of D University Financial Management Office operated by the victim educational foundation C from September 1, 2006 to September 20, 201, selling and managing the overdue revenue stamps to the library staff of D University, and depositing the sales revenue stamps into the school account.
1. On September 6, 2007, the Defendant embezzled the proceeds from the sale of parking revenue stamps, as well as selling one copy of 120,000 foot parking revenue stamps from the D University’s Financial Accounting Division and the office located in Seo-gu, Busan, Busan, to F, the Defendant voluntarily consumed the remainder of 8,60,000 won by paying the Defendant’s debt and living expenses, etc. from September 1, 2007 to February 28, 2008.
In addition, from around that time to August 31, 201, the Defendant voluntarily consumed and embezzled KRW 72,340,000,000, in total, for the sake of the victim, as shown in the annexed crime sight table (1).
2. On June 1, 2007, the Defendant embezzled the sales proceeds of loan books in arrears and the Defendant sold 11,645,990 won in total to the library staff affiliated with D University from March 1, 2007 to February 28, 2008, including the sale of 1,200 won loan books in arrears and 1,256,50 won to the person in charge of G Library loan loans at the same place, and sold the loan books in arrears and 11,645,990 won in total to the person in charge of library libraries affiliated with D University, and voluntarily consumed the remainder of 1,256,50 won in the Defendant’s debt repayment and living expenses.
In addition, the Defendant, from around that time to February 28, 201, together with the sales proceeds of borrowed books in arrears, as shown in attached Form 1 (2).
