1. Defendant B Co., Ltd. shall pay to the Plaintiff KRW 1,074,280,000 as well as the interest rate from March 13, 2012 to the day of full payment.
Reasons
1. Basic facts
A. On April 8, 2011, Defendant C, the representative director of Defendant D Co., Ltd. (hereinafter “D”) issued a contract for the construction work of the new construction of D Leecheon Logistics Center (hereinafter “instant building”) on the land outside E in E-si, Leecheon-si and the construction period from April 11, 201 to September 10, 201 with the Defendant Co., Ltd. (hereinafter “Defendant Company”).
B. On May 9, 2011, the Plaintiff was between the Defendant Company and the Defendant Company.
A subcontract was entered into with respect to the steel frame construction (hereinafter “instant construction”) among the port construction works, and the construction period, the construction cost, the payment method, etc. were determined as follows:
1. Period of construction: Value-added tax of 118,00,000 won for value-added tax of 1,298,000,000 won for the construction work on May 10, 201, and on July 2, 2011, completion: 118,00,000 won;
3. (1) Payment of the price (2) 100,000,000 won on May 31, 201 (2) 20,000,000 won on June 15, 2011 (3) : Payment of the completed amount of KRW 100,000,000 on June 30, 201: Payment on July 15, 201 following the end of each month -
C. On October 24, 201, the scheduled completion date of the instant construction period, the Plaintiff agreed to change the construction period between May 10, 201 and November 20, 201.
Defendant Company failed to pay KRW 450,000,000 among the construction price in the instant case, which was to be paid to the Plaintiff by June 30, 2011, and the Plaintiff claimed KRW 696,850,000 for the progress payment of the instant construction project until July 31, 2011, including the said money, to the Defendant Company.
E. The F director of D must complete the instant construction, which is the main process, from the new construction of the instant building, up to seven months. While the floor concrete construction of the instant construction was completed on or around September 201, the instant construction was delayed due to the delay in the construction, Defendant C already paid KRW 780,000,000 to the Defendant Company as the representative director, in order to identify the status of steel production.
