A defendant shall be punished by imprisonment for four years.

The defendant shall complete a sexual assault treatment program for 40 hours against the defendant.

Punishment of the crime

1. 성폭력범죄의 처벌 등에 관한 특례법위반( 친족관계에 의한 준강제 추행) 피고인은 2015. 1. 하순 00:30 경 서울 도봉구 C, 다세대 103호에 있는 피고인 거주의 원룸에서, 같은 직장 동료 이자 사촌 누나( 큰아버지의 딸) 인 피해자 D( 여, 25세) 가 아침 일찍 직장에 출근하기 위하여 위 원룸에 방문하여 함께 술을 마신 후 그곳 침대에서 잠이 든 것을 보자 순 간 욕정을 일으켜 추행할 것을 마음먹고, 피해자 몸 위에 올라 타 피해자의 왼쪽 가슴을 혀로 핥으면서 손으로 오른쪽 가슴을 수회 주물러 피해자를 강제로 추행하였다.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;

A. On February 2, 2015, at around 00:0, the Defendant: (a) visited the studio above in order to have the victim attend the workplace at a night after drinking alcohol; (b) intending to engage in sexual intercourse by causing the victim’s desire to sleep by taking advantage of his/her body; (c) had the victim’s hand on his/her body; and (d) had the victim detained his/her finger, and attempted to rape the victim by raising his/her chest on his/her chest with other hand; (d) however, the Defendant did not commit an attempted crime by failing to carry out his/her body, sound, resisting the victim’s body, and resisting him/her.
