1. The Defendant: KRW 6,561,912 to the Plaintiff and KRW 6% per annum from January 26, 2013 to July 11, 2014; and

1. Basic facts

A. The Plaintiff is a person running the lease business of registration number D digging machines (hereinafter “instant digging machines”) with the trade name of “C,” and the Defendant is a juristic person established for the purpose of civil engineering and building business, etc., and was awarded a contract from Nonparty 2, Korea Development Co., Ltd. (hereinafter “instant construction”).

Article 3 Operation hours of construction machinery under paragraph (1) shall be eight hours a day and two hundred hours a month.

Where the standard hours referred to in paragraph (1) fall short of the standard hours due to reasons attributable to the plaintiff under paragraph (2), it shall be deemed that the standard hours have been operated due to reasons attributable to the defendant.

The rental fees under the provisions of paragraph (2) such as the rental fees under the provisions of Article 4 (1) shall include the amount of wages for a construction machinery operator, the amount of wages for a construction machinery operator, the expenses for mechanical maintenance (repair, maintenance expenses

Paragraph (1) of Paragraph (1) of the payment terms of the rental fee under Article 6 shall pay the rental fee to the Plaintiff from the end of each month if the period of the rental of construction machinery exceeds one month, and from the end of each month if the period of the rental is not more than one month, the rental fee shall be paid to the Plaintiff by the due

B. On May 21, 2012, the Plaintiff entered into a construction machinery lease agreement (hereinafter “instant construction machinery lease agreement”) with the Defendant on May 21, 2012, setting the period of use from May 22, 2012 to May 21, 2013; the basic working hours per hour - 49,250 won per hour (excluding value-added tax); and the extended working hours - 60,750 won per hour (excluding value-added tax); and some of the contents are as follows.

C. The Defendant around September 2012, 2012: (a) White Land Co., Ltd. (hereinafter “White Land Co., Ltd”) and Section 1 Co., Ltd., part of the instant construction.
