A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 D과 함께 2015. 4. 29. 경부터 2016. 4. 26. 경까지 중국 이하 불상지에서 E 이라는 상호로 온라인 쇼핑몰을 운영하면서 ‘루 이비 통, 샤넬, 구 찌, 프라다’ 등의 위조 상표가 부착된 가짜 명품 가방, 지갑, 벨트, 신발, 의류, 시계, 액세서리 등을 판매한 사람이고, F는 2016. 3. 31. 경부터 2016. 4. 26. 경까지 위 쇼핑몰의 국내 배송 포장 업무를 담당한 사람이며, G은 위 쇼핑몰의 반품 업무를 담당한 사람이다.

No person shall commit any act infringing on another person's trademark right or right to exclusive use.

1. The Defendant and the Defendant jointly committed the crimes of D and D in collusion with D and G, from July 20, 2015 to April 26, 2016, in order to sell “STSNE 7 points (an amount equivalent to KRW 1,750,000 at the fixed price) with a trademark registered with the Korean Intellectual Property Office,” and “D2D SURED RED 2” with a trademark registered with the Korean Intellectual Property Office from July 20, 2015 to April 26, 2016, the Defendant sold the forged goods with the trademark indicated in attached Table 1(1), thereby infringing upon the trademark right holder’s trademark right at least 51(501,70,700 won).

The Defendant and the Defendant jointly committed the crimes of D, F, and G in collusion with D, F, and G, from March 31, 2016 to April 26, 2016, sold 1 points on which the trademark “LOUSVUTN” registered with the Korean Intellectual Property Office (or equivalent to 1,200,000 won at the fixed price) is attached, and thereby infringing the trademark right of each trademark right holder by selling 103 points (or 139,050,000 won at the fixed price) attached with a forged trademark, as described in attached list of crimes (2).
